1. Acceptance of Terms

By accessing or using Rechurn ("Service"), operated by Rechurn ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Rechurn is a SaaS platform that helps businesses recover failed subscription payments through automated email sequences, AI-enhanced messaging, and save offers. The Service integrates with third-party payment processors (e.g., Stripe) on your behalf.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Billing

  • The Service is offered at a flat rate of 49€/month.
  • A 30-day free trial is included for new accounts.
  • Billing is handled through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • No refunds are provided for partial billing periods.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws, including CAN-SPAM, GDPR, and other anti-spam or data protection regulations.
  • Send emails to recipients who have not consented to receive communications from you.
  • Attempt to reverse-engineer, decompile, or disassemble the Service.
  • Interfere with or disrupt the Service or its infrastructure.
  • Share account credentials or allow unauthorized access.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. We process your data solely to provide the Service.

7. Third-Party Integrations

The Service integrates with third-party services (e.g., Stripe). Your use of such integrations is subject to the terms and policies of those third parties. We are not responsible for the availability or actions of third-party services.

8. Intellectual Property

All rights, title, and interest in the Service, including software, design, and content, remain our property or that of our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription.

9. Limitation of Liability

To the maximum extent permitted by law, Rechurn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, or data. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will recover any specific amount of failed payments.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable member state where Rechurn is established.
